Course Creator 360 Terms of Use & Refund Policy

1. Terms

By accessing this website and purchasing products from Course Creator 360 and its related entities (hereafter CC360), you are agreeing to be bound by these Terms of Use and all applicable laws and regulations. 

IF YOU DO NOT AGREE WITH ANY OF THESE TERMS, YOU ARE PROHIBITED FROM AND INFORMED NOT TO USE OR ACCESS THIS SITE NOR TO PURCHASE ANY OF THE PRODUCTS MADE AVAILABLE TO THE PUBLIC BY COURSE CREATOR 360 AND ITS RELATED ENTITIES.

2. Grant of License

Permission is granted to temporarily download one copy of any downloadable materials on the CC360 website for personal, non-commercial private viewing only. This permission is the grant of a license, not a transfer of title, and under this license you may not:

-modify or copy the materials;

-use the materials for any commercial purpose, or for any public display (commercial or non-commercial);

-attempt to decompile or reverse engineer any software contained on the CC360 web site;

-remove any copyright, trademark  or other proprietary notations from the materials; or

-transfer the materials to another person or 'mirror' the materials on any other server

This license shall automatically terminate if you violate any of these restrictions and the License may be terminated by CC360 at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. Disclaimer/Disclosures

The materials on the CC360 website are provided 'as is'. CC360 makes no warranties, expressed or implied about its products viability or the business opportunity  and hereby disclaims and negates all  warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, CC360 does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

COURECREATOR360 DOES NOT HOLD ITSELF OUT AS A POST​ SECONDARY SCHOOL AND PROVIDES NO EDUCATIONAL STATE CREDITS NOR ANY STATE AUTHORIZED DEGREES OR CERTIFICATES THAT COULD BE USED FOR POST SECONDARY SCHOOL BENEFITS OR ALTERNATIVES OF ANY KIND. MOREOVER THE SERVICES TRAINING AND PRODUCTS ARE NOT GUARANTEED TO MAKE YOU MONEY AND YOU CANNOT RELY TO THE CONTRARY.

4. Limitations

In no event shall the we be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the CCP website or use of its training and products. even if the CC360.   Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you and such Jurisdictional choice of laws will prevail.

5. Revisions and Errata

The materials appearing on the CC360 website may include technical, typographical, or photographic errors. CC360 does not warrant that any of the materials on its web site are accurate, complete, or current. CC360 may make changes to the materials contained on its web site at any time without notice. CC360 does not, however, make any commitment to update the materials.

6. Links

CC360 has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by CC360 of the site. Use of any such linked website is at the user's own risk.

7. Site Terms of Use Modifications

CC360 may revise these Terms of Use for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these Terms of Use and you will be responsible to make ongoing and regular review of these terms.

8. Governing Law

Any claim relating to the CC360 and its related entities  website shall be governed by the laws, venue and Jurisdiction of Salt Lake County, State of Utah,  without regard to its conflict of law provisions.

9. RELATIONSHIP OF PARTIES

It is understood by you that you are a Customer or Licensee only.  CC360 will not provide any fringe benefits, insurance, vacation or otherwise upon your becoming a member.  Any and all of your family, staff employees and associates shall be bound to the same terms as you under this agreement.


10. CONSENT

Upon purchasing a course from CC360, you consent to receive emails about content updates, promotions, and various other newsletters.

11. Your Content

11.1. Ownership and Responsibility of Your Content

We understand that the content you create is valuable to you and we want to make sure that you retain all ownership and responsibility over it. Therefore, Course Creator 360 does not claim ownership over any of your Content.Your Content includes but is not limited to software (including machine images), data, text, audio, video or images, coaching offerings, and personal data uploaded, collected, posted, stored, displayed, distributed, or transmitted on or in connection with your account or your site.

You agree that Course Creator 360 is not responsible for any third-party content that may be included in your Content and makes no representations or warranties as to such content. We only require limited rights to your Content to provide the Product to you, as described in these Terms. By using our Product, you represent and warrant that you have the necessary licenses, rights, consents, or permissions to use or publish the Content that you include, submit, or use through our Product. You also represent and warrant that none of your Content or your End-Users’ use of your Content or the Product will violate any applicable laws or the rights of any third party. We respect your intellectual property rights and expect you to respect ours. You acknowledge that we may terminate your access to the Product if we reasonably believe that you have infringed on the intellectual property rights of others. If you believe that your intellectual property rights have been infringed upon by any Content on our Product, please contact us immediately so we can address the issue.


Acceptable Use Policy. You are prohibited from suggesting or implying that your Content is sponsored, provided, or endorsed by Course Creator 360. You are solely responsible for determining the fees you charge your End-Users for accessing your Content, website(s), and products, as well as any refund policy related to the sale of your Content. The Product may enable you to export your Content, including links to videos created through the Product, and share them on social media and networking sites. You are solely responsible for distributing such exports or links and complying with the terms of any third-party websites, applications, services, or products through which you distribute them.

11.2. Limited License to Your Content. We do not claim any intellectual property rights over your Content. However, by uploading Content through the Product, you grant Course Creator 360 a worldwide, royalty-free license solely for the purpose of providing the Product to you and as permitted by the Privacy Policy. This license continues even after you stop using the Product, with respect to aggregate and de-identified data derived from your Content and any residual backup copies of your Content made in the ordinary course of our business. This license also extends to any trusted third parties we work with to provide the Product to you. If you submit any feedback or suggestions to us regarding our Product, we may use and share them for any purpose without any compensation or obligation to you.

11.3. Use of Your Business Name and Trademarks. To promote our Product, Course Creator 360 may use the names, trademarks, service marks, and logos associated with your business, subject to your prior written approval. Any goodwill resulting from such use of your name and logo will accrue to your benefit.

11.4. Intellectual Property Infringement Claims. Course Creator 360 values and respects the intellectual property rights of others and expects our users to do the same. If you believe that any Course Creator 360 user is infringing upon your intellectual property rights, you may report such infringement by contacting us at support@coursecreatorpro.com.

11.5 Non-Exclusive Services. We reserve the right to provide our Product to your competitors and do not guarantee exclusivity in any particular market segment. You acknowledge and agree that Course Creator 360 employees and contractors may also use our Product, and may compete with you, provided that they do not use your Content or confidential information in doing so.

12. Fees and Payments

12.1. Fees for Using Course Creator 360. You are required to pay CC360 for every product you use, as per the pricing and payment terms presented to you for that product. Stripe and PayPal are third-party payment processors that we use to bill you through your payment account linked to your CC360 account. Payment processing is subject to the terms, conditions, and privacy policies of the applicable payment processor, in addition to this Agreement. You will be charged through the billing method you select via your account management page. If you have chosen to pay by credit card, you must ensure the accuracy of the credit card information you provide and promptly inform CC360 of any changes to such information. Paid fees are non-refundable, except when provided for in these Terms or required by law. Technical support for the product is included in your fee and is available exclusively to CC360 customers. Our support agents are not trained in custom-coding, and it is your responsibility to provide technical support for any custom-coding. CC360 accepts no responsibility for providing such support. All fees and charges are in US dollars, and all payments must be in US currency. We will not credit, refund or reimburse you for any foreign exchange fee charged by your credit card or any difference in fees due to currency conversion.

12.2. Subscriptions Our product is available on a subscription basis. This means that you will be charged in advance on a recurring, periodic basis, which we refer to as a "billing cycle." Depending on the subscription plan you select when purchasing, billing cycles are usually monthly or annual. Payment will be charged to your chosen payment method when you confirm the purchase and at the beginning of every new billing cycle. Your subscription will automatically renew at the end of each billing cycle unless you cancel your account through your online account management page or by contacting us at support@coursecreatorpro.com before the end of the billing cycle. We do not want to lose you as a customer, but you can cancel your subscription at any time by changing your subscription. In this case, your subscription will continue until the end of that billing cycle before terminating. You can also cancel auto-renewal on your subscription immediately after it starts if you do not want it to renew. If you sign up for a plan with a free or discounted trial period and do not cancel your account before the stated trial period expires, you will be charged for the full price of the plan starting the day after the trial period ends. If you cancel before the processing of your first invoice following the trial period, you will not be charged. We may change the price for subscriptions from time to time and will communicate any price changes to you in advance and, if applicable, how to accept those changes. Price changes for subscriptions will take effect at the start of the next subscription period following the date of the price change. By continuing to use your subscription after the price change takes effect, you accept the new price, as permitted by local law. If you do not agree with the price changes, you have the right to reject the change by cancelling your subscription before the price change goes into effect. Please ensure that you carefully read any notification of price changes. We use Stripe and PayPal, our third-party providers, to keep your payment information, such as non-sensitive credit card partial numbers and expiration date, on file. We do not access this information except through provided programmatic methods by the provider(s). It is your responsibility to keep your payment details up-to-date by changing the details in your account settings. When your details change or are due to expire, we may obtain or receive from your payment provider updated payment details, including your card number, expiration date, and CVV (or equivalent). This enables us to provide you access to the Product. At CC360, we take our billing policies seriously. When you make any changes to your plan during a trial period, this will automatically end the trial. If you decide to upgrade, you will be billed immediately for your first term period, whether that's annual or monthly. Any upgrades or downgrades made after the trial period will result in automatic charges to your credit, debit, or other payment card on your next billing cycle at the new rate. If you choose to upgrade to a higher-priced plan during your current billing cycle, we'll bill you immediately for the prorated difference.

In the event that a downgrade results in a credit on your account, we'll apply that credit to your next billing cycle(s). Please note that we do not provide refunds for any account credits.

Our goal is to ensure that our billing policies are fair and transparent. If you have any questions or concerns, please don't hesitate to contact us.

12.3. Taxes. We understand that tax laws and regulations can be complex, so we want to be transparent about how taxes are handled for purchases of our product, Course Creator 360 (CC360). Please review the following terms and conditions regarding taxes:

  1. Our prices for CC360 do not include any taxes, levies, duties, or similar governmental assessments of any nature, such as value-added, sales, use, or withholding taxes, unless otherwise indicated. You are solely responsible for paying any Taxes associated with your purchase of CC360 and for keeping your billing information up to date.

  2. United States Sales Tax: If we have a legal obligation to pay or collect sales tax for which you are responsible, we will calculate the sales tax based upon the billing information we have about you and charge you that amount. If your billing information is incomplete or inaccurate, we may charge you the highest prevailing rate then in effect. If you provide us with a valid tax exemption certificate acceptable to the appropriate taxing authority, we will refund the sales tax collected. By providing a tax exemption certificate, you represent and warrant that it accurately reflects your tax status and that you will keep such document current and accurate.

  3. Non-United States Sales Tax: If applicable, we will charge you any value-added tax (VAT), goods and services tax (GST), or any other sales, consumption, or use taxes that arise in connection with your purchase of CC360, unless you provide us with a tax identification number that entitles you to an exemption, a valid tax exemption certificate, or other documentary proof issued by an appropriate taxing authority that tax should not be charged. If you are located in a jurisdiction with multiple sales, consumption, or use taxes, we may charge you the highest prevailing rate if your billing information is incomplete or inaccurate.

  4. Withholding Taxes: If you are required by law to withhold any Taxes from your payments to CC360, you must provide us with an official tax receipt or other appropriate documentation to support such payments.

We hope that this policy helps you understand how taxes are handled for your purchase of CC360. If you have any questions or concerns, please do not hesitate to contact us.

12.4. Price Changes. CC360 retains the right to modify the fees charged for the Services at any time. However, for Products charged on a subscription basis, any fee modification will only be effective at the end of the current billing cycle of your Subscription. CC360 will notify you of any fee changes in advance, and you will have the option to terminate your Subscription according to the terms specified above.

12.5 Refund Policy. At CC360, we aim to make every new customer's experience a positive one. Therefore, we offer a full refund within thirty (30) days of initial sign-up, no questions asked. If you wish to cancel your plan, simply send us an email at support@coursecreatorpro.com within 30 days of sign-up. All payments made thereafter are non-refundable, and we do not provide credits for partially used subscription periods. As previously stated, access to the Product will continue until the end of the current billing period following cancellation. We maintain the right to reject refund requests from anyone who abuses our Refund Policy.

Section 12.6 Authorized Payment Method. It is mandatory to keep a valid payment method on file with CC360 to pay for all fees. CC360 will charge applicable fees to any Authorized Payment Method that you approve, and we will continue to charge the Authorized Payment Method for applicable fees until this Agreement is terminated, and any and all outstanding fees have been paid in full.

Section 12.7 Delinquent Payments: At CC360, we strive to provide uninterrupted service to our users. In the event that we are unable to process payment of any fees using your Authorized Payment Method, we will notify you of the payment failure within a reasonable time frame (a “Payment Failure Notice”). If outstanding fees remain unpaid for 14 days after we have provided a Payment Failure Notice, we reserve the right to suspend or revoke your access to the Product or certain services within the Product, at our sole discretion. Your full access to the Product will be reinstated upon payment of any outstanding fees, in addition to the fees applicable to your next billing cycle. If outstanding fees are not paid within 30 days of CC360 providing a Payment Failure Notice, we may terminate your access to the Product or certain services within the Product, at our sole discretion. Your full access to the Product will be reinstated upon payment of any outstanding fees, in addition to the fees applicable to your next billing cycle.

Please note that during any period of suspension or after termination, you may not be able to access the Product or certain services within the Product, which may affect your ability to provide your content, products, and/or services to, or process payments from, your end-users. You acknowledge that CC360 is not liable for any disputes, claims, losses, injuries, or damages of any kind that may arise out of any impacts on your relationship with your end-users as a result of any suspension or termination of your access to the Product. You agree to indemnify CC360 for any such disputes with your end-users in accordance with Section 13 of these Terms and Conditions..
